Terms & conditions

Please read the following terms and conditions carefully before using Maliyaa. All users of the Maliyaa site agree that access to and use of this site is acceptance of the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not use or access this site.

1. General information

a – The following sales and delivery terms are valid for all orders unless otherwise confirmed in writing by Maliyaa. The placing of an order by the buyer implies that the buyer is aware of these conditions and accepts them without reservation.
b – All agreements that conclude under the terms of these conditions are also governed by Dutch law.
c – All prices listed in euro’s (EUR) are inclusive of the Dutch VAT (GST) rate of 21%. All prices listed in Australian dollars (AUD) or United States dollars (USD) are exclusive of the Dutch VAT (GST) rate. All shipping costs are included worldwide (unless stated otherwise).
d – Terms of payment: 100% must be paid before shipping. Once the full payment is received by the Maliyaa account, delivery will occur.
e – Maliyaa reserves the right to refuse or cancel any orders, if the price of the artwork on the Maliyaa site has an accidental typographical error. This also applies if the order has already been confirmed and paid for. If your payment has already been made for the purchase and your order is cancelled, Maliyaa will contact you within 24 hours and will refund the amount of the incorrect price or offer you an alternative.
f – Maliyaa reserves the right to make amendments to these terms and conditions at any time.

2. Delivery

a – Once an order is received by the Maliyaa administration, buyers will receive a confirmation email to the address entered during their transaction. All information received is strictly confidential and will be handled securely and with care.
b – All paintings are sent unstretched and rolled in a tube, unless the artwork is a framed piece measuring 30x30cm, an artwork framed at the buyer’s request or an artwork that has delicate Ochre paint which may be damaged if rolled.
c – Depending on the size of the artwork we use UPS, PostNL and Correos ES as our main delivery companies.
d – We normally ship all artworks within 4-7 days after payment.
e – If for any reason we can’t meet the delivery date, we will inform the buyer and offer a choice of either continuing with the extended delivery time or a cancellation with a full refund. Reasons for delay can be: hold-ups in transport chosen by us and other unforeseen circumstances.

3. Price and Payment

a – The prices on Maliyaa in Euros include all shipping costs and the Dutch VAT (GST )of 21% and apply for all countries in Europe (unless stated otherwise).
b – The prices on Maliyaa in Australian dollars (AUD) or United Sates dollars (US) include all shipping costs worldwide, but doesn’t include the Dutch VAT (GST) (unless stated otherwise). Maliyaa will only charge you the VAT (GST) (21%) if you life in Europe or want us to ship the artwork to an address in Europe.
c. – Additional costs and taxes charged in the country of delivery are the responsibility of the buyer.
d. – Prices are liable to change at any time but changes will not have an effect on orders already made.

4. Return of goods and refunds

a – Maliyaa offers a 14-day return policy and a 100% money back guarantee. The buyer needs to contact Maliyaa within 7 days of delivery to return any goods. If- after contact- the goods are returned within 14 days and in good condition Maliyaa will give a full refund.
b – The buyer can also replace the purchased artwork for another Maliyaa artwork up to the value of the originally purchased artwork.
c – The artwork must be returned in it’s original condition with all associated documents included.
d – When returning an artwork, it must be securely wrapped in its original packing. The return shipping cost are at the buyer’s expense and it is recommended that any artwork is insured.
e – If you received your artwork and it’s been damaged during transport, you need to inform Maliyaa immediately and within 24 hours from delivery. Photos should be taken to show the current state of the artwork. Depending on the damage, Maliyaa will either try to repair it locally, or the artwork can be returned for a full refund or replaced for another artwork of equal value. Maliyaa will cover all costs of the repair or return delivery.

5. Copyrights notice

a – Everything on the Maliyaa site is copyrighted unless otherwise noted.
b – Artists own the copyright for their original artworks as per Copyright Law.
c – All users of the Maliyaa site should be aware that all artworks shown are copyrighted and remain the property of the Artist exclusively.
d – Reproducing any of the artworks presented on the Maliyaa site in any format without the written permission of Maliyaa, the Artist or their agents is not allowed.
e – The Maliyaa site is an All Rights Reserved site and no portion of the Maliyaa site may be copied, reproduced, transmitted, derived or otherwise used for any purpose without the prior written permission of Maliyaa.

6. Trademarks

All Maliyaa’s site trademarks are owned by Maliyaa and may not be used for any purpose without official prior written permission.
